ISLAMABAD: During hearing on application related to recovery of Baloch missing student, Islamabad High Court Justice Mohsin Akhtar Kayani remarked it comes to know in missing persons case that even statement of Prime Minister does not carry weight.Justice Mohsin Akhtar Kayani inquired that the institutions which are under the law, they can be regulated and which act above the law, what is their regulation? Islamabad High Court adjourned hearing on application for recovery of Baloch missing student till May 21.Justice Mohsin Akhtar Kayani conducted hearing on a petition filed for recovery of Baloch missing student. Attorney General for Pakistan Barrister Mansoor Usman Awan appeared before the court and presented report of recovered persons. Justice Mohsin Akhtar Kayani remarked in this petition violation of human rights had been pointed out. It is clear that state courts would not protect any terrorist.Justice Mohsin Akhtar Kayani said question arises when some act is done above the law and added they ca n check what the police does either it is right or wrong. Lawyer Imaan Mazari while presenting arguments said the day caretaker prime minister appeared before the court the same day a Baloch student was picked and the next day this missing student was freed in Rawalpindi.Justice Mohsin Akhtar Kayani remarked that police is dismissed as it acts in front of all while is there anyone in agencies who is accountable where is self-accountability which could be observed. He said his opinion is against the missing persons' commission as they work along with whom against those who are accused. He said the institutions which are under the law, they can be regulated and which act above the law, what is their regulation? He said there could be mistake in working but it does not mean that it is not accountable.Justice Mohsin Akhtar Kayani remarked if someone is terrorist then register an FIR against him. He said the role of agencies would be under which law the way it is for Federal Investigation Agency (FIA) and othe r institutions. He said every institution has to work while remaining under its jurisdiction and court also has to work while remaining under its jurisdiction. According to law, there are thousands issues of resolving any matter. Justice Mohsin Akhtar Kayani remarked if a person in a home is missing how much his mother and sister suffer. He said tell about a committee in which there were DG ISI, DG IB and DG MI.The attorney general told the court that in this regard they have approached the Supreme Court. To this, Justice Mohsin Akhtar Kayani said the amendments you wanted in the order, file a miscellaneous application and satisfy the court. He said they have to sort out the issue of missing persons and if there is some objection with regard to making the committee then tell the reasons to satisfy the court. Justice Mohsin Akhtar Kayani said that petitioners' lawyer is telling the day the prime minister gave a statement over here the same day a person is picked up. It shows that there is no significance of statement of the prime minister. Afterwards the court adjourned hearing of the case till May 21.
