IHC stops police from registering blasphemy cases against PTI leadership

ISLAMABAD: Islamabad High Court (IHC) has restrained police from registering blasphemy cases against PTI leadership.

Chief Justice (CJ) IHC Athar Minallah has remarked prima facie this case can not be made . the state should make all the leadership sit together and decide that religion will not be used as tool.

Fawad Chaudhry appeared before the court and told the people can murder any one on the basis of these religious cases.

The CJ IHC inquired has government not learnt a lesson from Sialkot incident.

The counsel for Qasim Soori told the court Qasim Soori was also attacked on that day.

The court remarked it is responsibility of the state to see these matters. The religion should not be used in politics. The state will do what.

Deputy Attorney General (DAG) Syed Tayyab Shah told the court “ give me time. I get directions.

Fawad Chaudhry told the court I have become surprised over these cases. Injustices have been done earlier too. Martial laws were imposed. But no one registered blasphemy cases. No one has any hope from this interior minister. I have deep connection with law minister. But I was much surprised over him .

Fawad Chaudhry said they have introduced such a custom of which the consequences are disastrous.

The court remarked using religion for personal motives is itself contempt. This is grave violation of human rights. It is job of the political leadership to promote tolerance in the society. If there is no tolerance in the society then such things will happen. Then it will be wrong. What has occurred was absolutely wrong. Prima facie the cases registered in Pakistan are not correct. A tragic incident has taken place in Sialkot earlier. Mishal Malik incident also happened.

The court observed Islamabad Police have reported that investigation is underway in respect of four petitions. The case has not been registered. The religious sentiments are praise-worthy. But there is responsibility of state too. One application was submitted in this court which was rejected. The religion should not be dragged into politics this way. This is fact that the state has done such things on the basis of religion in the past. These happened or otherwise but the lives of the citizens were put at stake.

Deputy Attorney General (DAG) told the court the petition seeking dismissal of the case should have been submitted in the respective court.

Faisal Chaudhry advocate counsel for Fawad Chaudhy told the court no government is in place in Punjab at present. 500 to 700 people were involved in this case. Imran Khan, Sheikh Rashid, Qasim Soori and Shahbaz Gill have been nominated in this case. Our stance is very clear that our resignation has been accepted.

The court remarked this constitution can keep all united. This constitution has been disgraced too much in the previous 70 years. It is job of political leadership to inform the people that the c constitution is supreme law and the institutions are subordinate to this constitution. The political leadership should also make such expectation from the leadership of the institutions that they should work as per constitution. If they don’t work according to the constitution then it is job of political leadership to hold them accountable.

Fawad Chaudhry requested the court to dismiss the case against them.

What case was registered, I have seen and it should have not been registered. What is going on should be stopped in future how, the court remarked.

DAG told the court these are the sentiments of people and private people have filed applications.

Fawad Chaudhry told the court people are so much emotional that all have filed similar petitions.

The CJ remarked there should be some principles in the politics. Religion should not be used for it.

The court while summoning attorney general for assisting it on next hearing adjourned the hearing of the case for two weeks.
