Can SC registrar file petition in high court: IHC raises question

ISLAMABAD: Islamabad High Court (IHC) has raised a question can registrar Supreme Court (SC) file petition in high court.

The court raised this question during the hearing of petition filed by SC registrar against the decision of Pakistan Information Commission (PIC).

The court sought assistance from Attorney General (AG) on the maintainability of the petition with reference to it.

Additional Attorney General (AAG) Amir Rehman appeared in the court.

AAG told the court PIC ordered registrar SC to provide information to citizen. This decision was given under the act of access to information. Court is constitutional court. This does not fall under federal law. As per law PIC can not issue such order against SC.

PIC said we are not authorized to review our decision.

The CJ IHC Athar Minallah remarked writ cannot be issued against the registrar. How can he be aggrieved party.

The court while seeking assistance from Attorney General adjourned the hearing of the case for three weeks.
