EC should decide again after hearing all respondents if LB polls in Islamabad will take place on Dec 31 or otherwise: IHC

ISLAMABAD: Islamabad High Court (IHC) has nullified the election commission notification on rejecting the government decision for increasing the number of union councils with reference to Local Bodies (LB) polls in Islamabad.

The court remarked the election commission should decide again after hearing all respondents if LB polls will take place in Islamabad on December 31 or otherwise. It will be decided by election commission itself.

The petitions with regard to LB polls in Islamabad came up for hearing before single bench of IHC led by the Chief Justice (CJ) IHC Aamer Farooq Friday.

The CJ IHC remarked the problems in Islamabad will not be resolved unless the small parliament like Delhi comes in Islamabad.

PTI counsel while raising objection over Jahangir Jadoon application said Advocate General (AG) has not made us respondents. PTI is the largest party of all in LB polls

The CJ remarked this is court proceedings. Here speech has not to be delivered. Is it the mandate of federal government to increase number of union councils.

AG told the court notification has been issued and legislation has also been enacted. Interior ministry issued notification on increasing number of union councils on December 19 but election commission rejected this notification by exercising suo motu powers. EC has not even heard federal government and metro corporation.

PML counsel said that election commission mandate is holding elections as per law.

AG told the court we have increased the number of union councils and have not changed the area.

Counsel for EC told the court our stance is elections are held as per schedule.

Raja Inam Minhas, petitioner from the side of voters told the court election commission presented the record pertaining to change in voters lists in the court. Voters of Golra are included in Rawat and voters of Rawat are included in Golra. When voters went to EC then it said that change cannot be made after announcement of election schedule.

The court remarked election commission should tell its final stance what it is.

DG EC told the court our stance is this that elections are held as per schedule.

The court announced reserved judgment after hearing the arguments of lawyers of respondents.

Money laundering case: Court accepts interim bail plea of Suleman Shahbaz son of PM

LAHORE: Accountability Court (AC) Lahore has accepted interim bail plea of Suleman Shahbaz son of Prime Minister (PM) Shahbaz Sharif in money laundering reference.

The court has approved interim bail plea till January 07. The bail plea has been accepted against surety bonds in the sum of Rs 5 lac.

The court has ordered Suleman Shahbaz to participate in the investigation.

During the hearing of the case the judge AC directed Suleman Shahbaz to present his identity card in the court.

Suleman Shahbaz replied the identity card is not available with him and he regrets. In future I will bring identity card, he said.

The court remarked the identity card was needed today. This should be available with oneself always.

LHC reinstates Parvez Elahi as CM Punjab

Lahore: Lahore High Court reinstated Chaudhry Parvez Elahi as Chief Minister of Punjab.

Court suspended the notification of de-notifying Chaudhry Parvez Elahi from the post of Chief Minister from Governor Punjab.

After the notification was suspended, Chaudhry Pervez Elahi's post as Chief Minister was restored.

In the hearing of the petition against de-notification of Punjab Chief Minister Chaudhry Pervez Elahi by the governor, the full bench of Lahore High Court asked Pervez Elahi's lawyer to come with instructions that the assembly will not be dissolved until the vote of confidence is taken.

During the hearing of Parvez Elahi's de-notification case, Justice Abid Aziz Sheikh asked if we suspend the governor's notification, will you immediately dissolve the assembly?

Take out the Manzoor Watto case and read it, maybe it has happened before.

Justice Abid Aziz Sheikh remarked that the assembly will not be dissolved until the vote of confidence is taken.

Pervaiz Elahi's lawyer pleaded that more time is needed for undertaking on not to dissolve the assembly.

If the court reinstates Parvez Elahi, then the court should issue an order that the assembly will not be dissolved.

On which Justice Abid Aziz Sheikh remarked that how can we issue such an order.

Or we should not give you interim relief, after which lawyer of Pervaiz Elahi said that the purpose undertaking is that no one can misuse it.

It takes some time to get the assurance in writing.

The Honourable Court issued notices to the Punjab Governor, Attorney General and others, for next hearing on 11th of next month.

Earlier, during the hearing, Chaudhry Parvez Elahi's counsel Barrister Ali Zafar presented an affidavit signed by Chaudhry Parvez Elahi, declaring that if Governor's notification is suspended, then Punjab Assembly will not be dissolved till the next hearing.

EC,others put on notice in the case of increasing number of union councils by govt

ISLAMABAD: Islamabad High Court (IHC) has issued notice to election commission and all respondents for Friday on a contempt of court plea against the federal government on the matter of increasing number of union councils before Local Bodies (LB) polls in Islamabad.

Contempt of court plea filed by PTI leader Ali Nawaz Awan against the government came up for hearing before single bench of IHC led by Chief Justice (CJ) IHC Aamer Farooq T hursday.

He told the court during the hearing of the case high court has already given a decision on the matter of enhancing the number of union councils. High court had stopped from further increasing number of union councils. The contempt of court was committed by increasing the number of union councils. Contempt of court proceedings be initiated against the Prime Minister (PM) Shahbaz Sharif and others.

Attorney General (AG) Ashtar Ausaf came on rostrum. DG Election Commission (EC) too appeared in the court.

The court inquired from DG EC has any new notification come regarding union councils.

DG EC told the court yes notification had come but we have issued order on it.

DG EC told the court we have issued this order the LB polls for Islamabad will take place timely.

The AG told the court the petitioner has not challenged the notification on increasing the number of union councils.

The counsel for EC told the court EC has decided to hold LB polls even after issuance of notification by the government.

The court while addressing the counsel for the petitioner remarked how the contempt of court has occurred when the polls are taking place.

The court remarked the approval for increasing number of union councils was given by federal cabinet then why the petition is only against the Prime Minister. The court cannot stop legislation. How can we stop cabinet from the legislation? If there is any problem we hope opposition and government will resolve it together. Voters have also filed petition against the change of votes. In my view that matter is more important. How can we stop parliament from enacting legislation.

The court further observed there is another petition on this matter that the voters have come to the court. We will club all the petitions with reference to local government and hear them at one time.

The decision of EC for rejecting the federal government notification on increasing number of union councils was challenged on this occasion.

The court issued notice to election commission and all respondents for Friday.

The hearing of the petitions regarding LB polls was adjourned till today (Friday).

Court summons Imran Khan on January 18 in the case of hurling threats on female judge

ISLAMABAD: District and Sessions Court Islamabad has summoned Imran Khan on January 18, 2023 in the case of hurling threats on female judge.

Senior civil judge Rana Mujahid has issued notice to Imran Khan.

Islamabad police has filed challan of the case in the court.

It is pertinent to mention here that Imran Khan had threatened female judge during a public meeting in Islamabad. Later he had apologized to the court.

Chairman PTI had appeared in the court of female judge where he had asked the court staff to inform the female judge about his apology.
