EC reserves judgment on reference seeking disqualification of PTI 25 dissident MPAs

ISLAMABAD: Election Commission (EC) has reserved judgment on the reference seeking disqualification of 25 dissident provincial assembly members of PTI.

A 3-member bench of Election Commission (EC) led by Chief Election Commissioner (CEC) Sikandar Sultan Raja took up the reference for hearing Tuesday.

Ali Zafar, counsel for PTI said that the counsels for the dissident members gave arguments show cause notices were not issued to these members and they did not know about it. In fact they had refuted the facts. Were they unaware of the entire situation or they were dreaming while the entire country was aware of it.

They gave arguments that parliamentary party did not give directives.

He argued that the facts were these the party issued directive on April 01 that vote has to be cast in favor of Pervez Elahi. The affidavit of chief whip and parliamentary leader were given and all MPAs were directed to cast vote in support of Pervez Elahi. It means vote be not cast to someone else.

Member ComCommission Nasir Durrani said that the members had differences over the PTI candidate.

Member commission Shah Muhammad Jatoi said MPAs should have been told that vote has not to be cast to someone else. It was necessary as Pervez Elahi had boycotted the election.

Counsel for         PTI said it has been said by the counsel from opposite side parliamentary party had not issued directives. Only mention has been made of parliamentary party in article 63-A and details have not been narrated. In this regard party head or majority of members can decide.

He said this argument is unjustified that members were not forbidden from casting vote in favor of rival candidate of Pervez Elahi. Directives were issued all members to cast vote in favor of Pervez Elahi. Chief Whip had also informed the members through letter .Imran Khan tweeted this decision as well which was read by million of people. However Chief Minister Election could not be held on April 03. Secretary General PTI Asad Umar informed the members through letter. Despite it dissident members attended meeting held in Flatties hotel too.

Faisal Chaudhry counsel for the PTI while presenting the original receipts of Courier Company before election commission said they want to file original receipts of Courier Company.

Barrister Ali Zafar counsel for PTI said that the dissident members were given full chance to explain their position. However no one gave reply to show cause notice. The dissident members have accepted about casting vote in their written reply.
