Govt,prosecutor put on notice in the case challenging appointment of special prosecutor in Shahbaz Gill case
ISLAMABAD: Islamabad High Court (IHC) has issued notice to the respondents in the case challenging the appointment of special prosecutor Raja Rizwan Abbasi in Shahbaz Gill case and sought reply from them.
The federal government and special prosecutor are among the respondents.
Shehar Yar Tariq advocate appeared on behalf of the petitioner.
The counsel for the petitioner said when law officer is there then the appointment of special prosecutor is against the law.
Objection was raised in trial court against the appointment of special prosecutor. Special prosecutor cannot take part in the prosecution proceedings.
The court inquired had any notification been issued in respect of appointment of special prosecutor.
The counsel for the petitioner said interior ministry had issued notification.
The court remarked under what law the notification was issued.
The counsel for the petitioner told the court no law is there in this regard. The deputy attorney, assistant attorney, state counsels and DSP legal can appear in public prosecution cases.
The court while issuing notice to the respondents adjourned the hearing of the case after holidays.
