Has earth swallowed missing persons or heaven has devoured them, wonders SC

ISLAMABAD: Justice Mian Saqib Nisar has remarked “ ministry of defence should tell if the earth has swallowed the missing persons or heaven has devoured them.

He remarked “ ministry of defence should tell where the missing persons have gone. If the heaven has devoured them or earth has swallowed them. Government has enormous resources and even then non recovery of the missing persons is regrettable. Police can do nothing against any intelligence agency. Termite is eating into the life of missing persons. Government should realize that the allegations should not be levied against it. There is such a mammoth government institution but the missing persons are not being recovered. Policy of evasion will not work for a long time. Court cannot close its eyes. No one will be allowed to breach law and constitution.

He gave these remarks during the course of hearing of missing persons including Hafiz Muhammad Jamil and Hammad Aamir case on Monday. Justice Nasir ul Mulk presided over the bench.

Justice Nasir ul Mulk remarked “ government should tell cases of these missing persons are pending since the last two years. Lack of progress in these cases is beyond comprehension. When every institution is denying then these youth have gone where. Are they alive or they have died. A new explanation comes on every hearing. This will run for how long more.

Additional Attorney General (AAG) Tariq Khokhar, Amna Masud Janjua and deputy director legal Muhammad Irfan Bhatti appeared in the court.

The defence ministry told the court with reference to Hafiz Jamil missing person that the copy of the list has not been provided to the defence ministry which was presented in Sindh High Court (SHC) and was hinted at by Amna Masood Janjua. Due to this no headway has been made in the matter.

The court ordered for presenting copy of the list and orders of SHC before it.

Court later heard the case of missing person Hammad Aamir who was picked up from Westridge Rawalpindi.

During the hearing, AAG Tariq Khokhar told the court that ISI had denied presence of missing person Hammad Aamir while Military Intelligence (MI) has sought two weeks time .

Court inquired “ this missing person at last has gone where.

Father of Hammad told the court the solid evidence are available that he is in the custody of these intelligence agencies and footsteps of the matter go to I-9 Islamabad.

Another person from Vehari had told on telephone that “ my son is all well and there are no charges against him and he is in Islamabad”, father of Hammad further told.

The court said in its ruling “ Amna Masood Janjua has told that all other persons who were detained with Hammad Aamir have been released and these persons have told that Hammad Aamir has been kept somewhere in I-9 in Islamabad.

The court directed the defence ministry to investigate the matter in details in the light of these solid evidence and present detailed report. The court also has summoned director legal Muhammad Irfan on February, 3 besides adjourning the hearing till February, 3.
