ISLAMABAD: Islamabad High Court (IHC) while accepting petitions filed by different companies and institutions has declared imposition of super tax unconstitutional.
Justice Sardar Ijaz Ishaq Khan announced the reserved judgment.
The court while declaring section 4-c of income tax ordinance unconstitutional made explanation with reference to section 4-c in its detailed decision.
The court has nullified all notices of demand and recovery of super tax .
Suleman Akram Raja, Adnan Haider Randhawa advocate and others pursued the case on behalf of the petitioners.
In June Lahore High Court while declaring super tax just had reduced it from 10 percent to 4 percent.
Justice Jawad Hassan had issued 30-page decision wherein it was said that imposition of super tax on major companies with over 300 million rupees income is correct.
Under law super tax cannot be levied more than 4 percent.
