ISLAMABAD: Islamabad High Court (IHC) has restrained all ministries and departments from implementing recommendations of National Assembly (NA) Special Committee for affected employees in connection with reinstatement and regularization of government employees,
The case against reinstatement and regularization of government employees under the recommendations of national assembly special committee came up for hearing before single bench of IHC led by Justice Mohsin Akhtar Kiyani.
Justice Mohsin Akhtar Kiyani of IHC announced the decision Tuesday.
It has been said in the decision that Pakistan Steel Mills, FIA, CDA , EOBI and Pakistan Foundation should not implement special committee recommendations. If the committee recommendations on reinstatement has been implemented then the department should cancel these orders.
The court while accepting all the petitions of petitioners against special committee recommendations declared the disciplinary action illegal against the officers who have not implemented committee recommendations.
The decision said that under rules of business of national assembly, special committee cannot transgress its set powers. Federal government too did not support the recommendations of special committee. There is no legal status of recommendations of special committee. Committee was mandated to send the recommendations to parliament. Committee had started sending directives directly to institutions.
The committee ordered EOBI to reinstate 358 employees who were sacked under court's order.
This gave impression that committee is above law and is out of constitutional mandate. Impression too emerged that it was working against the scheme of distribution of powers among institutions.
