Implementation on constitution, law corporate responsibility of judiciary, state: SC

ISLAMABAD: Supreme Court (SC) has sought comprehensive report from federal and provincial governments report on recovery of 23 remaining missing persons (35 minus 12) within 3 weeks.

The court remarked “protecting the fundamental rights of the citizens is responsibility of state. Proceedings be initiated as per law against missing persons and those found responsible in the matter . Implementation of constitution and law is corporate obligation of state and judiciary. Those who are found involved in violation of law among the missing persons, be proceeded against under law and constitution.

Justice Jawwad S Khawaja has remarked “ report of all the commissions constituted so far has not been published deliberately. Yasin Shah is not only citizen of a province but he is also citizen of federation. Therefore violation of his rights will not be allowed. This is of paramount significance that state should itself uphold constitution and law. To what we have drawn attention repeatedly is protection of human rights.

A 3-member bench of SC headed by Justice Jawwad S Khawaja resumed the hearing of 33 missing persons case on Friday.

Attorney General (AG) appeared in the court He presented copy of FIR registered in Malakand police station against army officer in missing persons case and told FIR has been registered on the report of defence minister. One member commission has also started functioning under Justice (retd) Mian Muhammad Ajmal. Its report will be presented within a month.

The court expressed satisfaction over it and expressed hope that federal government will take this matter to logical end and ensure recovery of the remaining missing persons. “We want fundamental rights of any citizen be not breached and his rights be protected.

The court ordered federal and provincial governments to present elaborate report on recovery of the remaining missing person besides summoning report from one member commission within a month.

The hearing of the case was adjourned for three weeks.
