LAHORE: Lahore High Court (LHC) has nullified care taker Punjab governmnet notification on suspending the decision for giving the status of division to Gujarat, district to Wazirabad and Tehsil to Ahmad Pur Chatha.
The petitons filed by Ikhlaq Chatha and others came up for hearing before single bench of LHC led by Justice Shahid Kareem Wednesday.
These petitioners through their petitons had challenged the Punjab care taker government notification for suspending the status of Gujarat as division, Wazirabad as district and Ahmad Pur Chatha as tehsil.
Qazi Mubin and Suleman Makhdoom Tippu counsel for petitioners raised this point the care taker government is not empowered to suspend the steps taken by former Chief Minister (CM) Punjab Chaudhry Pervez Elahi. These decisions were taken by an elected government and its cabinet. The care taker government cannot suspend the steps taken by former government on permanent basis.
The lawyers pointed out the job of care taker governent is to deal with the daily matters and hold transparent elections.
The lawyers told the court the caretaker government cannot take steps of permanent nature. The powers for taking decision on policy matters rest with the elected government only.
The lawyers requested the court to nullify the care taker government notification on suspending status of Gujarat as divison, Wazirabad as district and Ahmad Pur Chatha as tehsil.
The court accepted the petitions of identical nature.
