SC gives time to military intelligence till January, 7 for recovery of missing person

ISLAMABAD: Supreme Court (SC) has given time till January, 7 to military intelligence for recovery of Hammad Aamir who had gone missing from Rawalpindi.

The court also directed Additional Attorney General (AAG) Tariq Khokhar to obtain solid evidence about the missing person that MI and ISI have picked him up.

Amna Masud Janjua told the court that 5 to 6 persons had not only spotted Hammad Aamir in ISI detention center at Islamabad but also they had met him.

A 3-member bench of SC headed by Justice Nasir ul Mulk took up for hearing Hammad Aamir missing person case here Friday.

Amna Masud Janjua and AAG Tariq Khokhar appeared in the court. AAG told the court that Hammad Aamir is resident of Rawalpindi. Door of his home was knocked on November, 17, 2009. 5 persons had come to the door of his house and one among them was constable of Islamabad police. Hammad Aamir is missing since then. Case was registered on July, 14, 2012. Case was registered after 3 years. “ I had asked to contact the respective intelligence agency. Two reports are available. One is police report and one report bears the date December, 19, 2013. No date is mentioned on second report.

About Aamir Mehmood it was told no case was registered. The court inquired that had he any link with Jehadi outfit. Tariq Khokhar told nothing like this was there. He had contacted ISI and had given the report. MI and ISI had ordered for holding inquiry into this matter afresh. No record on their part is available. Efforts are underway. Report will be sent to SC at individual level as soon as it is ascertained. Two weeks may please be given.

The court inquired from Amna Masud Janjua who in her view seems involved in this matter. Amna Masud told 6 persons have returned from detention. They have told that Hammad is still held by an agency and is under detention in Islamabad.

Justice Nasir ul Mulk remarked if they can give statement. Justice Saqib Nisar remarked “ I have observed people avoid giving affidavit . We can send the matter to sessions judge Islamabad if they want to record their statements.

Justice Nasir ul Mulk remarked “ evidence can come to light in this connection. We want evidence. Amna Masud Janjua said “ I will try to obtain their affidavits. Can I give affidavit on their behalf.

Justice Nasir ul Mulk remarked “ no, it can not be done. Amna Masud Janjua said she was told that he would be released after Eid ul Fitr but that time has been elapsed. Justice (Retd) Javed Iqbal was also told this thing. The hearing of the case was adjourned till January, 7, 2014.

A 3-member bench of SC headed by Chief Justice of Pakistan (CJP) Tasadduq Hussain Jillani while disposing of another petition in respect of missing person Abdul Rehman remarked an old enmity was prevailing between father of Abdul Rehman and his rivals. Sessions Judge Lahore should investigate into the matter and initiate action as per law. Its report be sent to SC till January, 13.
