Islamabad: Islamabad High Court (IHC) while adjourning the hearing kidnapping of woman and her minor daughters till next week has sought progress report from concerned authorities.
Justice Mohsin Akhtar Kayani of IHC has remarked abducting a woman and girls after filing 5 fake cases is what a justice.
He gave these remarks during hearing of kidnapping of mother and her two minor daughters here Thursday.
I can fix the case for hearing on November 27 but I don't know I will remain here or otherwise, he further remarked.
The petition seeking dismissal of case against Waqas Ahmad and Sohail Aleem registered over financial dispute of PIA former Chief Executive Officer (CEO) Musharraf Rasul with them came up for hearing in IHC.
IHC directed FIA to continue investigation.
Justice Mohsin Akhtar Kayani remarked FIA should not issue any final order after conducting its investigation. Supreme Court (SC) has suspended a decision in this case. We will proceed according to it. We will move ahead the proceedings in the light of SC decision till next hearing. We will not touch it from where SC has restricted the action.
During the hearing of the case Justice Mohsin Akhtar Kayani expressed displeasure over the steps of Punjab police saying
" how is it justice to file five fake FIRs and abduct girls and a woman. No one has seen the plaintiff so far who is registering fake case. The matter related to steps taken by Punjab police was sent to Chief Minister (CM) Punjab because woman and her minor daughters were abducted in this case. CM Punjab too is a woman.
This matter was sent to her so that she could come to know her police is involved in kidnapping of a woman.
He remarked the money cannot be recovered through fake cases. The cases which you have registered cannot stay in trial even for 10 minutes. These fake cases will collapse during cross-examination-don't do this.
Items were stolen from the home of woman who was abducted and recovery was attributed to her. Petitioner is not a fair person who sold out property worth Rs 31 crore.
Senior police officers too support the subordinate police officers. This is strange.
Justice Mohsin Akhtar Kayani remarked he had no sympathy with the petitioner. If he was found guilty punishment would be awarded to him. I am not in favor of supporting any one who is indulged in illegal job. Protecting basic human rights is our duty.
We cannot stop any one from investigation. Check the location from where the woman and children were abducted and give report.
The counsel Shehryar Tariq said SC had suspended the high court October 24 decision. The decision was suspended on November 10 while November 5 decision of your court had already come.
Latif Khosa counsel for the petitioner said these people misguided the SC too. SC suspended October 24 decision and not of November 5 decision.
Justice Mohsin Akhtar Kayani said you both should see the SC decision. We will not give any decision unless any decision comes from SC.
Latif Khosa requested for fixing the next hearing on November 27.
Justice Mohsin Akhtar Kayani said how would I know if I will even be here on the 27th or otherwise?'
The court adjourned the hearing of the case till next week with these directives.
