Islamabad: Abid Zubairi, former president Supreme Court Bar Association (SCBA) has filed petition in Supreme Court (SC) against 26th constitutional amendment.The petitioner while making federation and provinces respondents has requested SC to declare 26th constitutional amendment unconstitutional. 26th constitutional amendment be declared against the basic rights enshrined in the constitution and basic constitutional structure. The judicial commission meeting in connection with appointment of judges be stopped. Approval for constitutional amendment cannot be sought from members forcibly,. Parliament is incomplete and there are legal questions on its constitutional status. Independence of the judiciary and distribution of powers is basic structure of the constitution. The basic structure of the constitution cannot be changed through constitutional amendment.Appointment of chief justice through parliamentary committee amounts to interference. Constitution of constitutional benches is establishment of a parallel judicial system against SC.
