Karachi: Pasban Democratic Party (PDP) Chairman Altaf Shakoor on Wednesday challenged the recent amendment of Sindh Building Control Authority (SBCA) to the Sindh High Court (SHC).Making Province of Sindh, through Secretary; Director General, Sindh Building Control Authority, (SBCA); Director General, Karachi Development Authority; Sindh Master Plan Authority Planning and Development Department Government of Sindh as respondents, he submitted that the Adamjee Nagar Cooperative Housing Society, where he lives is/ was considered to be the purely residential area where there are some of the residents who converted their residences into Commercial activity which has been defended by the residents on different forums.In his constitutional petition filed through Advocate Khurram Lakhani, he said that the recent amendment made in the Sindh Building Control Authority through a notification dated 13-03-2025, which the petitioner seeks to challenge the illegal, unlawful and excessive amendment to the Karachi Buildi ng and Town planning regulation 2002. He said the amendment notification has exceeded its authority and had gone beyond the vires of statute.He feared that the recent amendment will make this residential area into a commercial or semi-commercial area, disturbing it's peaceful environment and the residents/ petitioner will be facing obvious mental agony and tortures tagged with traffic noises as well as hundreds of strangers will be crossing in the vicinity due to sudden permission in carrying out commercial activities.He said that the impugned amendment has totally failed to mention or describe or explain any planning which shows the benefit to the residents of the residential area and no specific purpose has been mentioned therein. He said as per the terminology of the residential area means a place is dedicated to the resident only without having any commercial activities therein which Honorable court has the authority to set aside and declared as void pertaining to recent amendment in the SBCA Notifica tion.The petitioner maintained that the affix Court has also imposed banned on converting the residential properties into commercial or residential cum commercial properties, as such the impugned notification/ amendment is beyond the scope of SBCA which has assumed itself in altering the master plan of Karachi. It has failed to comply with any procedural formalities and passed this amendment in a hurry for the best reason known to them. He said making residential areas commercial would open gateways to huge corruption and bribery.He prayed to declare that the impugned amendment is void ab initio without any lawful authority. He prayed to set it aside and order to bring back the original position as per the Karachi Building and Town planning regulation 2002.
