Lahore: Lahore High Court (LHC) has declared illegal arrest of any person on the basis of supplementary statement. Justice Tariq Nadim maintained that DOUBT , verbal information or supplementary statement recorded late cannot be made basis for arrest.

The order was issued by Justice Muhammad Tariq Nadim of LHC while approving bail after arrest plea of Omar Farooq alias Ehtesham accused in murder case. The court issued detailed 11-page decision in this regard which will assume the position of court's precedence.

During the hearing of the case Additional IG Investigation Shahzada Sultan and other senior police officers appeared in the court.

On inquiring by the court Additional IG Investigation admitted no separate legal clause is available in respect of supplementary statement in criminal laws. Some time officers take shelter of supplementary statements for deceptive objectives.

The court maintained in its decision the offence confessed before the police is not acceptable evidence legally. Arresting some one on the basis of supplementary statement or statement which comes into open late does not conform to legal norms.

During hearing of the case, Additional IG Investigation assured the court no accused will be arrested on the basis of supplementary statement in future.

The court ordered IG Police Punjab to send copies of the decision to all Regional Police Officers (RPOs) , Capital City Police Officers (CPOs) and District Police Officers (DPOs) so that effective implementation of this order could be ensured.

The court ordered IG Punjab to take stern legal review of the arrests made on the basis of supplementary statements besides filing implementation report in respect of decision within two weeks.
