Islamabad: Judge Tahir Abbas Sipra of Anti Terrorism Court (ATC) Islamabad has approved physical remand of former member of assembly Ali Wazir for further 3 days.
Judge Tahir Abbas Sipra remarked ” I have to see if section is applicable or otherwise. I am sitting here as magistrate not as sessions judge. I can issue administrative order. Nothing has been done in 6 days. 6 days is very big remand.
He gave these remarks on Friday during the hearing of the case.
Former member of assembly Ali Wazir was presented in ATC on completion of his six days physical remand Friday.
Musaddaq Aziz Khattak counsel for Ali Wazir appeared in the court.
On the inception of hearing judge Tahir Abbas Sipra inquired tell us what have you done so far,
Upon it prosecutor Raja Navid told the court mobile phone has to be recovered. More investigation has to be made. 20 days physical remand be approved.
The counsel argued what a joke it is. Three cases have been registered. You want what now that he should be killed once. Case
of 3 kilogram charas was registered so that he could not be bailed out.
The investigating officer told the court we want mobile for this purpose that names and numbers of those people who blocked the way of police are there in mobile phone.
Prosecutor Raja Navid said remand for 90 days can be obtained in terrorism case.
Judge inquired if the judgment of Asif Saeed Khosa is only for the courts or it will apply to agencies too.
Prosecutor replied it is for all including agencies.
The judge remarked while registering FIR, the moharrar has to see the guidelines or not. One man hit another man and terrorism was not in his mind. Is section 7A-TA is applicable to him. It is not necessary that accused should file application to see section 23.
Judge Tahir Abbas Sipra said I have to see either section is applicable or not. I am sitting here as magistrate and not as sessions judge. I can issue administrative order.
Later the court reserved judgment on the plea of granting further physical remand.
