Karachi: Sindh High Court (SHC) while accepting the appeal in the case pertaining to attack on police during operation against encroachment has declared the conviction of the accused null and void.Appeal plea against sentence of 4 accused in the case of attack on police in Gadap Deh Thumming came up for hearing Tuesday.Anti Terrorism Court (ATC) had awarded 5 years imprisonment each to accused on the charges of attacking police.The court said in its order name of policeman injured in the attack is mentioned separately in police documents. The date for recording the statement of the injured police man is also recorded separately.The plaintiff identified the accused persons through their name. During the trial the plaintiff of the case gave statement that he has seen the accused for the first time.According to call data record location of three accused persons was not on scene.The accused persons presented ownership documents of the land during trial.Justice Umar Sial made observation in writt en order terrorism clauses are included in the case without fulfilling their necessary conditions. The repute of the country is hurt due to large number of terrorism cases.The court directed registrar to send court's observations to judges of ATC.
