Blasphemy case: DG NCCIA directed to present all witnesses in trial court

Islamabad: During the hearing of bail plea of the accused Hassan Abad arrested in blasphemy case since one and half year Islamabad High Court (IHC) has directed DG NCCIA to present all the witnesses in trial court on October 8.

Justice Mohsin Akhtar Kayani of IHC heard the case Wednesday.

Hadi Ali advocate appeared on behalf of the petitioner in the court.

Assistant Attorney General (AAG) Usman Ghumman, Adil Aziz Qazi and deputy director FIA appeared in the court from the side of respondents.

Justice Mohsin Akhtar Kayani directed trial court to complete the cross-questioning of witnesses by the lawyers on October 8 besides directing member inspection team of high court to visit trial court.

Justice Mohsin Akhtar Kayani remarked MIT committee should visit both the trial courts and file the report why the courts are not working.

The court directed MIT to file detailed report about trial court on next hearing.

Hadi Ali counsel for the petitioner said he wants to file some documents on new grounds.

The court inquired his bail plea was dismissed on merit. Do you want to file new documents. How many witnesses are in this case and how many have been cross- examined.

Hadi Ali advocate replied there are total 7 witnesses in this case and no witness has been cross questioned. Witnesses were summoned repeatedly for cross questioning but they did not appear.

Trial court does not issue arrest warrants on their non appearance despite issuance of summons. High court had given direction of 6 months earlier and then given direction of 8 months. It will expire within a few days.

The court reprimanded counsel Hadi Ali for not making old decisions of courts part of case record.

Moving to counsel Hadi Ali, the court remarked it is your job to make old orders of the court part of record and inform the court thereof.

The court inquired who is investigation officer in this case and where is he.

Deputy Director FIA said Mudassar Shah is investigation officer in this case and he has been transferred to Peshawar.

The court remarked tell the DG NCCI to present the investigation officer on October 8 in trial court.

The court while expressing resentment said the prosecution witnesses remained absent from case and the court's order was not complied with.

Justice Mohsin Akhtar Kayani remarked we will set an example by hearing this case on day to day basis.

Hearing of the case was adjourned till October 10.
