Lahore: During the hearing of petition against proceedings initiated under Property Ownership Act (POA) Chief Justice (CJ) Lahore High Court (LHC) Aalia Neelum has ordered to return the possession forthwith acquired through DRC Committee.

The petition filed by one Muhammad Ali came up for hearing before CJ LHC Aalia Neelum Friday.

The citizen who acquired possession under POA appeared in the court.

During the hearing of the case CJ LHC inquired from counsel of the citizen who sought possession how can he defend wrong decision.

The counsel took the plea the committees set up under DC's transgressed their powers.

The CJ LHC remarked return the possession first. Then there will be further discussion.

The CJ LHC also said this as to why the proceedings be not started against the members of committee.

CJ LHC said the counsel himself is admitting the DC's transgressed their powers. Had patwari done his job in time then this issue would not have arisen. Such problems will take birth if system is bypassed.

During the hearing of the case the counsel said people should go where if justice is not provided from system.

The CJ LHC remarked " don't make dialogue in the court for the sake of media news .

The CJ LHC observed she knows how many old cases are pending hearing in the courts.

The counsel said the rivals are illegally occupying 40 acres property in Depalpur.

The counsel for opponent party took the plea DRC's committees gave possession in 27 days.

The CJ LHC inquired who passed the order of possession.

CJ LHC Aalia Neelum maintained the order for possession given by committee falls in the ambit of misconduct.

The counsel admitted the committee gave wrong decision.

The CJ LHC said you yourself are admitting they had no power to give decision under law.

The court made it clear DC is not competent to give decision in this matter. The real question is not this the petitioner is owner of the property or otherwise but it is this have DCS powers to give such decisions or not.
