Islamabad: Islamabad High Court (IHC) while releasing important decision regarding Sheesha Caf© has maintained unjust and coercive action be not taken against the restaurants operating sheesha cafes lawfully under valid permits from competent authorities
The court directed the respective authority to complete effective regulatory framework and give final shape to the laws.
The court made it clear that the restaurants serving sheesha as per permit and licenses issued by competent authority and respective law will enjoy protection. However proceedings will be initiated as per law due to any illegal activity or violation of law, rules or permit.
IHC directed Islamabad Capital Territory Police to continue taking actions for preventing illegal sheesha activities and crimes related to drugs.
The court made it clear that distinction be kept in view between legal business and illegal activities.
Expressing concern over non completion of effective regulatory framework with reference to sheesha caf© directed federal government to ensure progress on this matter.
The court also ordered to take necessary steps to finalize the laws related to sheesha caf© which are under consideration of federal cabinet.
The court directed advocate general Islamabad and additional attorney general to raise the matter before the respective authorities and ensure the finalization of regulatory frame work required for sheesha caf©.
The court directed that requisite regulatory framework related to sheesha caf© be completed within a month besides ordering to file compliance report within a month in this regard.
According to court's decision the relevant rules and permit will have to be kept in view before taking action against sheesha cafes operating under legal permit. The action against the elements involved in illegal activities will continue as per law.
