Court accepts plea of daughter of former speaker SA to return to Pakistan, directs her to appear before court


Karachi: Constitutional Bench of Sindh High Court (SHC) while approving 20 days protective bail of daughter of former speaker Sindh Assembly (SA) late Agha Siraj Durrani on her petition in connection with return to Pakistan has directed her to appear in the respective court.



Constitutional bench comprising Justice Yusuf Ali Saeed and justice Abdul Mubin Lakho heard the petition.



NAB and state counsels opposed the petition.



The court inquired do you not want petitioner or absconding accused comes to Pakistan.



Justice Yusif Ali Saeed remarked She has to appear before Accountability Court (AC) on her arrival in Pakistan. The court can initiate proceedings as per law what it wills.



Why the constitutional bench was resorted to for bail and not the regular bench.



Amir Raza Naqvi advocate of petitioner said high courts exercise the powers of section 561 of criminal procedure in article 199 of the constitution generally. Constitutional bench wields the powers of regular bench in addition to powers regarding basic rights.



Justice Abdul Hamid Lakho said you did not present copy of ticket of the petitioner that she wants to come from where and when.



Amir Raza Naqvi said the petitioner is in US. Time for 8 to 10 weeks be given for her appearance in the court.



The court remarked such long time cannot be given.



The counsel said the tickets are expensive in the month of December .



The constitutional bench while approving protective bail of Sanam Durrani for 20 days directed her to appear in the respective court.
