Islamabad: Islamabad High Court (IHC) has ordered to arrange meeting of minor daughter to her Polish mother Anna Monica by taking her to Poland.
The court has sought report about online meetings.
The court issued these orders on a Polish woman Anna Monica petition regarding custody of her daughter.
Justice Mohsin Akhtar Kiyani remarked a mother cannot be stopped from meeting her daughter. No court can find solution to wife and husband dispute. Children are affected in Husband-wife disputes.
He gave these remarks during hearing of the petition filed by Polish woman Anna Monica Wednesday.
The counsel for the respective respondent filed implementation report in the court.
The counsel for the petitioner said the respective respondent is making excuses and is not cooperating. Mother of girl tried to meet her daughter through whatsapp or others on line sites. The respective respondent did not even arrange meeting of the girl on video link too.
The counsel for the father of the girl argued the trial court had rejected the plea of the petitioner for custody.
The court directed that there is meeting of girl with her mother. You should arrange the meeting of girl with her mother.
Justice Mohsin Akhtar Kiyani remarked we want to keep this case balanced.
The counsel said his client cannot go any where due to court's orders. Name of my client is included in No Fly List.
Justice Mohsin Akhtar Kiyani remarked girl will stay with her mother for some time and then she will make adjustment to some extent.
The court directed the father for taking the girl to Poland for meeting with her mother.
The court also directed FIA for not stopping the father of girl from going to Poland.
The court remarked father of girl can go wherever he wills to go but he cannot deceive the court. One case is running here and one case is running in Poland. What you have to say. But she is a mother and you cannot stop mother from meeting with her daughter. I always say no court can find solution to dispute between husband and mother. Children are affected in dispute between husband and wife.
The court while directing to present record regarding Online meetings on next hearing adjourned the hearing of the case till September.
