Islamabad: Case related to Dr Aafia Siddiqui release and repatriation to Pakistan case came up for hearing in Islamabad High Court (IHC). Dr Aafia Siddiqui is incarcerated in US .

Justice Sardar Ejaz Ishaq Khan heard the case Tuesday.

Clive Smith counsel for Dr Aafia Siddiqui in US appeared in IHC saying Aafia Siddiqui is being meted out extremely inhuman treatment in US Jail.

Counsel Imran Shafiq said it is miscellaneous petition of federal government that purpose of petition has been met and it should be wrapped up. We have filed miscellaneous petition to seek permission for amendment in the petition. It has been written in the 26th constitutional amendment that relief will be given as per request.

Counsel for Fouzia Siddiqui took the plea that request has been made repeatedly and purpose has not been met so far.

Justice Sardar Ejaz Khan remarked you can file new petition by giving reference to these grounds.

Imran Shafiq advocate said if we give new petition, it will be sent to some other bench.

Justice Sardar Ejaz Ishaq Khan remarked see it that lawyers have also started thinking this while it did not happen so earlier.

The counsel said if this court issues interim order to accept miscellaneous petition then it can be challenged in Supreme Court (SC).

Justice Sardar Ejaz Ishaq Khan remarked intra court appeals were heard against interim order in some other cases. stay was also given.

The counsel said this request has also been made in our petition that court can give any relief which it deems appropriate.

Amicus Curiae Zainab Janjua said high court has powers to give relief as per contents of the petition and situation.

Justice Sardar Ejaz Ishaq Khan remarked whosoever drafted clause A-1 of article 199 he mixed all.

The court remarked that clause related to full suo motu of courts was to be included like suo motu is taken on news paper clipping.

Justice Sardar Ejaz Ishaq Khan remarked this clause was mixed with the entire Jurice Prudence. The relief which the courts could give was mixed.

The court adjourned hearing of the case till next week.
