Extension in Afghan students visa case: We are in state of war with Afghanistan, Does our constitution allow Afghan nationals to file such petitions: IHC

Islamabad: Islamabad High Court (IHC) while raising legal question on the petition for extension in Afghan students visa has remarked we are in a state of war with Afghanistan at present and if Indian students come then will you too allow them to come.

The court remarked does our constitution give right to Afghan nationals to file such petitions.

The petition filed by 87 Afghan students seeking extension in their visas came up for hearing in IHC Friday.

Justice Khadim Hussain Soomro heard the petition.

Justice Khadim Hussain Soomro said " wakeel sahb, we are in a state of war with Afghanistan at present. If Indian students come then will you too allow them to come.

The counsel said Afghan students had come in 2023. At that time our national policy was some thing else.

Justice Khadim Hussain Soomro said does our constitution give right to Afghan nationals to file such petitions.

The counsel said students had come for one year. Government had issued visa to them.

Justice Khadim Hussain Soomro said " Wakil Sahb, You had obtained power of attorney from Afghan students under what law. You should go to Afghan embassy. Afghan embassy will contact Pakistan embassy.

IHC adjourned the hearing of the case.
