Islamabad: Federal Constitutional Court (FCC) has declared null and void the notification on granting life time perks and privileges to former chief secretaries of Balochistan.
The notification issued on granting life time benefits with the approval of Chief Minister (CM) Balochistan has been declared against the law.
FCC dismissed the appeal plea of chief secretary Balochistan.
4-page decision was authored by Justice Amer Farooq.
The FCC said every step taken by the government against the law is unjustifiable and unjust.
It has been said in the decision there is no room in law for lifetime additional perks and privileges for retired chief secretaries and their widows. On retirement the pension and other benefits can be given as per law in place.
The decision said the powers for making rules related to pay, pension and perks and privileges rest with finance department. Finance minister or chief secretary have no powers with reference to perks and privileges and pension.
In this case chief minister Balochistan gave approval for additional benefits which is against the law.
Constitution allows such steps on which no legal restriction has been imposed.
Balochistan government had given life time additional perks and privileges to former chief secretaries of Balochistan and their widows. Balochistan high court had declared additional life time perks and privileges against the law. .
Provincial government had filed appeal plea in FCC against BHC decision.
