FCC rejects plea for immediate reopening of Monal Restaurant

Islamabad: Federal Constitutional Court (FCC) has rejected the plea for reopening Monal Restaurant immediately. The review petition filed by CDA against the closure of Monal Restaurant came up for hearing Thursday.

A 3-member bench of FCC presided over by Justice Hassan Rizvi took up the case for hearing.

Justice Hassan Rizvi said as per SC decision there are rights of the animals but not of men.

Justice Hassan Rizvi said the case regarding renewal of lease of Monal hotel was pending hearing in civil court. Intra court appeals of some restaurants were pending hearing in high courts.

Counsel for Monal Restaurant said SC through one decision ordered to wrap up all the cases pending hearing in all courts.

Justice Hassan Rizvi inquired why the point of hearing the respective respondents was not raised in SC. Why all the lawyers had become deaf in SC.

Counsel Ahsan Bhon said we are standing here respectfully too as we were standing in SC.

Justice Hassan Rizvi said raising the legal points is job of lawyer. The courtiers stand respectfully. Solid points have not been raised in CDA review petition.

Additional Attorney General (AAG) said new law of Wild Life Board has come in 2024. All the lawyers are agreed that SC decision be nullified.

Ahsan Bhon said all the respondents are agreed that the case be let run in civil court.

Justice Hassan Azhar Rizvi said the courts don't run with the consensus among the lawyers. The SC has given what kind of decision can not be abolished with consensus. Detailed decision will have to be given to withdraw court's decision.

He remarked we don't want to impose decision on any one like SC. You want that we should give decision without hearing the respondents.

The court adjourned hearing of the case till second week of July.
