Islamabad: The Federal Constitutional Court (FCC) has provided a big relief to PTI Member of National Assembly (MNA) Sohail Sultan as the court has ordered Election Commission (EC) not to hear the case against him till further orders.
The court while issuing notice to EC and other respondents adjourned the hearing of the case for indefinite period.
The FCC stopped EC from initiating any proceedings against Sohail Sultan MNA from Swat till further orders besides issuing the notice to the respondents.
A two members bench of FCC comprising Justice Amir Farooq and Justice Rozi Khan took up the case for hearing Monday.
Barrister Gohar appeared on behalf of Sohail Sultan in the court during the hearing of the case.
Barrister Gohar took the plea when elections are held then the writ can be filed under article 199. Speaker was not empowered to send reference. Supreme Court had set this principle in Nawaz Sharif case.
The court while admitting the appeal for preliminary hearing issued notice to EC and other respondents.
Sohail Sultan was alleged of not completing two years period after becoming assistant advocate.
It is pertinent to mention here the EC had fixed the case for hearing tomorrow on Tuesday.
