Fixation of responsibility in missing citizen Faizan Khan case: IHC seeks progress report from FIA, Police

Islamabad: Islamabad High Court (IHC) has summoned progress report from FIA and Islamabad police till next hearing on the petition seeking fixation of responsibility in missing citizen Faizan Khan case besides adjourning the hearing of the case for indefinite period.

The court has directed Islamabad police should tell police have done what so far in investigation. FIA should present its detailed report.

Justice Babar Sattar has expressed dissatisfaction over progress report in the case so far.

He remarked a man disappears in the case which is before me and then he is recovered and his name is put in No Fly List. Man disappeared and no record in this regard is available. This court can do what. State is accountable in this case. One page report came. It was said therein we don't know. Nothing is known to us about disappearance of man. If police is doing its job then why they felt need to come to court. Police should see its character before leveling allegation.

Case came up for hearing before Justice Babar Sattar Monday.

Imaan Mazari, , counsel for the petitioner, Hadi Ali Chatha, Assistant Attorney General (AAG), State Counsel and FIA appeared in the court.

AAG took the plea this case looks like Mati Ullah Jan case.

Justice Babar Sattar remarked Mati Ullah Jan case is four years old case. State could not come to know who had lifted.

Imaan Mazari counsel for the petitioner said there are two petitions. One pertained to recovery and second related to placement of name in ECL.

The court inquired from AAG you had taken time in first petition.

AAG told the court reports from institutions have come as per your order.

Justice Babar Sattar inquired do these reports determine the causes that what had happened.

Imaan Mazari said as per CTD Punjab report Usman was not wanted to them in any case.

According to IB report the man was not recognized through CCTV footage. As per ministry of defence report they have no data about the kidnapped persons. Faizan had mentioned name of Brigadier Shehryar in his statement. Police had informed ministry of defence about it. As per IG police report they know nothing about it. Faizan recorded his statement before police for three hours.

The court inquired from the respective authorities when name was put in ECL.

Imaan Mazari said name was put in No Fly List in December 2024.

The court inquired from Imaan Mazari according to her what can be the results.

Imaan Mazari said security agencies did not cooperate with Police . Interior secretary should be held accountable who places name in the list.

According to FIR which has been registered it was responsibility of police to record statement of sector commander.

AAG said it has been mentioned in the petition that the man who was to be got recovered has returned home. The relief has been given which was sought from the court. FIR has been registered. The matter is being investigated.

Justice Babar Sattar said you have given 300 pages report to magistrate. You could not tell high court. You are saying magistrate can see this matter. Will magistrate now summon federal government, sector commander and police and take action.

State counsel said no report from FIA has come so far.

The court inquired tell us why the report has not been filed so far.

FIA said a new agency of FIA has been established which sees these information.

FIA sought time for filing report.

Justice Babar Sattar inquired you make sketch first and then send it to NADRA for identification.

State Counsel said yes it is as such.

Justice Babar Sattar remarked NADRA has identified how many people so far.

State counsel said he has no knowledge about it. Data has to be obtained.

The court inquired when agencies do any illegal job then what is procedure to investigate them.

Justice Babar Sattar said have you any estimation you are writing what in the report and are leveling allegations against the kidnapped person.

The court sought progress report from FIA and Police on next hearing.

The court adjourned the hearing of the case for indefinite period.
