Islamabad: Former Chief Justice of Pakistan (CJP) Jawad S Khawaja has filed contempt of court plea in Supreme Court (SC) against Prime Minister (PM) Shehbaz Sharif on the matter of giving right of appeal against military courts decisions within 45 days.

The counsel Khawaja Ahmad Hussain filed appeal in SC.

The appeal plea said SC announced decision of military court case on May 7.

SC ordered to give right to appeal to the accused convicted and sentenced by military court within 45 days.

Government did not enact legislation for granting right to appeal despite lapse of 45 days.

Contempt of court proceedings be initiated against PM for not implementing court's orders.

It has been said in the petition while inviting reference to article 90 of the constitution that said article says this as PM Pakistan is chief executive of the country. Therefore, this matter will come under him. And he will be accountable for it. As administrative head of federal government, PM is bound to implement court's orders.

Reference to the case regarding removal of former PM Yousuf Raza Gillani from his post has also been given in the petition wherein he had not implemented court's orders. Due to it he had to lose his post. Right to appeal to those convicted and sentenced by military courts has not been given so far which was to be given by federal government. Court's orders were to be implemented for this. The matter becomes contempt of court matter due to non implementation of orders. Therefore, contempt of court proceedings be initiated against PM Pakistan.
