Islamabad: Supreme Court (SC) constitutional bench has issued notice to federation and all provinces in the case pertaining to imposition of tax on ghee mills and sought reply from them besides adjourning the hearing of the case for indefinite period.During the hearing of the case justice Muhammad Ali Mazhar remarked full court remained no more after 26th constitutional amendment.Justice Jamal Mandokhel remarked Constitutional bench be considered full court now.He gave these remarks on making mention of full court bench decision by counsel for petitioner during hearing of the case of imposition of tax on ghee mills Tuesday.The petitioner had said it was an important case , therefore, full court bench be constituted.A seven members constitutional bench of SC presided over by Justice Amin ud Din took up the case regarding tax on ghee mills for hearing.Justice Jamal Mandokhel remarked he has given decision on the case in Balochistan High Court. I think I should not hear the case.Justice Jamal Ma ndokhel recused himself from hearing the case.The counsel for the petitioner said there is decision of full bench in this case.Justice Muhammad Ali Mazhar remarked full court remained no more after 26th constitutional amendment.Justice Jamal Mandokhel remarked constitutional bench be considered full count now.The constitutional bench while issuing notice to federation and all the provinces adjourned the hearing for indefinite period.
