Lahore: Lahore High Court (LHC) has observed honor killing is non compoundable offence adding law and religion does not allow murder in the name of honor. Justice Syed Farhad Ali Shah of LHC rejected the compromise deal in the case pertaining to murder of 18 years old girl in the name of honor besides rejecting the bail plea of two nominated accused.

Justice Syed Farhad Ali Shah maintained the compromise deal even does not give right of bail to the accused in honor killing case . Neither country's law nor religion allows murder in the name of so called honor. Such act falls under the ambit of simple murder. The court further maintained killing in the name of honor runs contrary to the basic right of life and freedom laid down in article 9 of the constitution.

Justice Syed Farhad Ali Shah maintained any compromise between the respondents or affidavit by the plaintiff and witnesses regarding deviation from their previous statements can not give benefit of bail to the accused persons because honor killing is non compoundable offence under section 311 of Pakistan Penal Code.

Justice Syed Farhad Ali Shah while dismissing bail after plea of Muhammad Nasir and Pervaiz maintained the evidence available on record prima facie involves the accused in the case. Case against the accused persons was registered in police station Kot Mithan District Rajan Pur on June 11, 2021. According to FIR the accused are charged with murdering about 17, 18 years Najma Mai by opening fire along with Abdul Karim and Ghulam Murtaza.

The court maintained particularly in the decision that an affidavit regarding compromise with the accused by a legal heir cannot benefit them because Abdul Karim who has given affidavit is himself co-accused in this case.

The court made it clear the observations made during the phase of bail are of temporary nature and these will not influence the trial.
