Husband is bound to pay money or jewelry mentioned in Nikah nama to her former wife after divorce: LHC


Lahore: Lahore High Court (LHC) while declaring family court decision on giving the jewelry mentioned in Nikahnama to his former wife by the husband has remarked husband is bound to pay money or jewelry mentioned in the column of Nikah nama after divorce.



If husband does not give the jewelry mentioned in the Nikah Nama then the wife is entitled to the amount under market value.



Justice Sajid Mehmood Sethi of LHC Multan bench issued decision on the petition filed by Amir Ali.



The decision said the petitioner got written Rs 5000, 5 tola silver and 10 tola gold in Nikah Nama as dower.



According to the woman her former husband has not given jewelry as dower after divorce.



As per the petitioner dower was fixed Rs 5000 which was paid.



It has been said in the decision according to the counsel of the petitioner family court did not take correct review of material of Nikahnama.



The court while upholding the decision of family court ordered to make full payment of dower.
