Islamabad: Islamabad High Court (IHC) has issued written order for hearing the petitions against solitary confinement of PTI founder Imran Khan and Bushra Bibi remarking grave allegations of solitary confinement and treatment against the law in jail cannot be ignored.
Justice Khadim Hussain Soomro has issued 10-page written order on the petitions filed by Aleema Khanum and Mubashra Monika. The order said that grave allegations like solitary confinement and illegal treatment in jail have been leveled in the petitions. These allegations cannot be ignored nor the other respondent can be rejected without notice or jail authorities report.
It has been said in the decision the record reveals rigorous and simple imprisonment was announced to prisoners in case of non payment of penalty. Solitary confinement was not awarded to PTI founder and Bushra Bibi at all.
According to written order NAB prosecutor told the allegations of keeping PTI founder in solitary confinement are false. According to NAB prosecutor such allegations have been leveled to serve political objectives. Superintendent Adiala jail should present detailed report based on facts regarding solitary imprisonment of PTI founder and Bushra Bibi.
It was told in the decision that if PTI founder and Bushra Bibi have been kept in solitary confinement then it has been done so under the order of which authority. If it is as such then PTI founder and Bushra Bibi were kept in solitary confinement by jail authority under what law. If it is solitary confinement then what is its period.
IHC while summoning report from jail authorities has said that report on condition of both the prisoners in jail and facilities given to them as per jail rules be also presented. The competent officer should appear in court on next hearing with complete record of jail and relevant documents. The court while issuing notice to superintendent jail, IG Jails and NAB has remarked the maintainability of the petitions will be determined after receipt of report from superintendent jail. The further hearing of the case be fixed on August 6.
