Islamabad: Islamabad High Court (IHC) has issued detailed judgment in respect of its order for removing name of collector Customs of FBR Muhammad Aamir Thaheem from PCL.
According to written decision Deputy Attorney General (DAG) requested for declaring the petition non-maintainable due to availability of alternative forum.
He said petitioner can resort to review committee of DG Immigration and Passports under passport rules.
The court while rejecting the plea said if there is apprehension that basic rights will be affected due to illegal order then power of jurisdiction of article 199 of the constitution can be used.
Under the recommendation of FIA , name of petitioner was included in PCL by director general immigration and passports.
Name of court absconder or the accused persons in heinous crimes can be included in PCL. Petitioner is neither court absconder nor is involved in any heinous crime.
The court ordered to remove name of the petitioner from PCL.
Barrister Raja Abdul Qadir counsel for the petitioner appeared in the court while deputy attorney general Faisal Irfan appeared on behalf of federation.
