Islamabad: Islamabad High Court (IHC) has issued notice to FIA on acquittal pleas of Imran Khan and Bushra Bibi in Toshakhana-2 case.
The court while issuing notice has sought reply from FIA till January 28.
The court while rejecting the plea of counsel for PTI founder for issuing stay order and sending the case to other bench has sought arguments from him on merit on next hearing.
Justice Inam Amin Minhas said those were bail pleas and this is a separate issue. This court will hear the case. Give the arguments on the merit of case.
The acquittal pleas of PTI founder and Bushra Bibi in Toshakhana-2 case came up for hearing before Raja Inam Amin Minhas Thursday.
Barrister Suleman Safdar counsel for PTI founder prayed the court to issue stay order on trial of Toshakhana-2 case.
Justice Raja Inam Amin Minhas said there is no court's precedent of staying criminal proceedings on this occasion. Let the other respondents come. We see after hearing both of them. We hear the second respondent by issuing notice on your petition.
Barrister Suleman Safdar gave references to different court's decisions.
He said this is case of prosecution that gift was received and was given for making estimate. The orders about two bail pleas are also attached. Trial court be ordered to stop trial.
Justice Inam Amin Minhas remarked indictment has been framed in trial court. Statements of the witnesses are being recorded. We seek reply from other respondents by issuing notice. We issue notice in it and will not give long date.
Suleman Safdar said it means I am returning today with taking nothing from here.
The court remarked you have come here for acquittal. We can direct trial court to complete the proceedings soon.
The counsel for petitioner said trial is running very fast. We will appear when we are summoned. Trial court can summon for three times. There is my right too here. The hearing can take place daily. It is requested trial court be stopped from giving final decision. The case be referred to some other bench.
Barrister Suleman Safdar took the plea earlier Justice Miangul Hassan Aurangzeb has heard five petitions related to this case. It will be appropriate that court should return acquittal petitions to that court.
