Islamabad: Islamabad High Court (IHC) while issuing notice to the respondents on the petition regarding production order of PTI senator Ijaz Chaudhry for attending Senate session has sought reply.
The petition seeking court orders for issuing production order of Senator Ijaz Chaudhry to attend Senate session came up for hearing before acting Chief Justice of IHC Justice Sarfraz Dogar Thursday.
The court while issuing notice to the respondents sought reply till Wednesday.
Babar Awan counsel for the petitioner appeared in the court.
The court inquired does this matter not fall in jurisdiction powers of Lahore High Court (LHC).
Counsel for the petitioner said it falls in jurisdiction powers of IHC. There are three major reasons in this regard.
Babar Awan cited to cases of Muhammad Khan Junejo, Javed Hashmi and different decisions of Supreme Court (SC).
IHC while issuing notice adjourned the hearing of the case till Wednesday.
Federation through interior ministry and secretary Senate have been made respondents in the petition.
The petitioner has taken plea he was arrested on May 9, 2023 under MPO which was abolished by LHC.
Later his arrest was shown in May 9 bogus and fake case. I am imprisoned in Lahore jail. I am senator and participation in Senate session is my right.
The petitioner requested that order be issued for his participation in every Senate Session and joint session of parliament.
