IHC nullifies 25 years imprisonment of person for killing girl, remands back case to trial court for decision again

Islamabad:: Islamabad High Court (IHC) has nullified 25 years imprisonment of one Shahzad convicted and sentenced in case of murdering a girl due to her refusal to marry him.

The court has maintained in its decision the entire decision of trial court has failed in explaining the award of 25 years sentence.

Trial court should give decision again on the basis of causes of the case. Why the death sentence was not awarded to accused of Qatli-Amd. Trial court should write causes for decision.

Justice Mohsin Akhtar Kiyani of IHC issued 8-page decision on the appeal plea of convicted person Shahzad who was awarded 25 years imprisonment on murdering a 24 years girl for refusing to marry him.

Decision said that according to plaintiff Shahzad kept on chasing Sonia for five months and then sent message for marriage.

According to counsel Shahzad hurled life threats on girl and her father on refusal from marriage. Sonia was shot dead on November 30, 2020.

IHC decision said it is responsibility of trial court to state clear reasons in regard to punishment awarded to accused. Trial court awarded 25 years rigorous imprisonment to the accused under section 302-C. Punishment under section 302-C can be awarded in such cases where punishment of Qisas cannot be awarded.

The decision on awarding 25 years punishment is annulled. The case is remanded back for deciding it again.
