Islamabad: Islamabad High Court (IHC) has declared null and void the notification in respect of appointment of president of Pakistan Nursing and Midwifery Council Farzana Zulfiqar.

Justice Tariq Mehmood Jahangiri of IHC issued 30-page detailed judgment wherein the court has ordered to restore Jawad Amin Khan as president and Shahid Hussain as vice president of Pakistan Nursing Council.

Jawad Amin Khan was removed from the position of president of Pakistan Nursing and Midwifer Council during care taker government.

It has been said in the written decision Supreme Court (SC) decision in regard to powers of care taker government is there. The job of care taker government has been explained in election act 2017 too. Petitioners were appointed with the approval of Prime Minister and federal cabinet.

De-notifying the petitioners without approval of federal cabinet is defiance of order of SC.

The court said in written decision neither any show cause was given to the petitioners nor any inquiry was conducted against them before de-notifying them. No such document has been brought on record on the basis of which the petitioners were removed from their positions.

The court ordered Jawad Amin and Shahid Hussain be restored to the positions of president and vice president respectively within a week.

The respondents should implement the decision and file report with Additional Registrar Judicial.
