IHC nullifies EC decision for not providing counter foil of ballot papers in respect of NA-138 LHR

Islamabad: Islamabad High Court (IHC) has nullified order of Election Commission (EC) for not providing counter foil of ballot papers of NA-128 Lahore.Chief Justice (CJ) of IHC justice Aamer Farooq has issued written order of the petition regarding provision of counter foil of ballot papers of NA-128 Lahore.It is mentioned in court decision the petitioner resorted to EC to acquire counter foil of ballot papers in respect of NA-128 Lahore.EC rejected the petition for provision of counter foil on April 26.According to rule the petitioner can review counter foil and attested copies as well.The court maintained the stance of EC too is correct that the matter of NA-128 is pending hearing in tribunal.According to EC, the election tribunal can call all the record including counter foil any time.IHC said in its decision the documents can slip hither and thither due to scrutiny of counter foil. However EC can obtain permission from Election tribunal with reference to provision of counter foil. EC can im plement proper rules and regulations with reference to review of counter foil.It was further said in the decision the plea against the decision of EC is accepted and EC April 26, 2024 decision is declared null and void. EC should decide about provision of counter foil in the light of law and court's decision.
