IHC rejects govt plea for imposition of immediate ban on political conversation with prisoners

Islamabad: Islamabad High Court (IHC) while rejecting government plea for imposition of immediate ban on political conversation during meetings with the prisoners in jail has issued notice on intra court appeal.The court took up for hearing appeal plea filed by Chief Commissioner (CC) Islamabad against the court decision on nullifying the restrictions imposed on political conversation during the meeting with prisoners in jail.The court while rejecting the plea for suspending the decision of Justice Sardar Ejaz Ishaq Khan forthwith has issued notice to Sher Afzal Marwat and sought reply in next week.Advocate General (AG) Islamabad told the court single bench decision on nullifying section 265 of jail rules by Justice Sardar Ejaz Ishaq Khan has been challenged. Rule 250 relates to Punjab prison rule. IHC had no powers of jurisdiction in this regard. Single bench had no powers to interfere in Punjab prison rules.The CJ IHC Aamer Farooq inquired was 27-A notice issued to Attorney General or advocate ge neral.Advocate general Ayyaz Shaukat replied I was summoned but formally no 27-A notice was issued. It is our request to suspend single bench decision.CJ IHC remarked be relaxed. We are issuing notice for next week. Issuing notice to Attorney general or advocate general is must for declaring any law null and void.The court adjourned the hearing of the case till next week.
