Islamabad: Islamabad High Court (IHC) has reserved judgment on the petition seeking formation of Judicial Commission (JC) to probe into Journalist Arshid Sharif murder case.Chief Justice (CJ) IHC Aamir Farooq remarked what happened yesterday, Pakistan is in state of war at present Still youths are going out from country.Attorney General (AG) told the court during hearing of the case agreement has to be signed with government of Kenya. Access was given by the government of Kenya to some extent. Later fact finding report was evolved. Government of Kenya expressed resentment when this report was made public. He has presented this report before the court.The case came up for hearing before CJ IHC Aamer Farooq Tuesday.AG appeared.During the hearing of the case AG told the court agreement has to be reached with government of Kenya. The report was completed after this. The draft of agreement has been accepted by the cabinet and now it will be sent to government of Kenya. Two Pakistanis were investigated on the matter of Arshid Sharif Shaheed.The CJ IHC remarked this application relates to JC. What is stance of Pakistan government on the whatever agreement which has either been reached or otherwise.AG told the court five members bench of Supreme Court (SC) has been constituted. The case will be heard after summer vacations.The CJ IHC remarked if JC is constituted in Pakistan then can the investigation be made in Kenya. Authorities of Kenya are not bound to appear before commission.AG replied it will not happen so. Difficulties will come even after agreement with government of Kenya.Later Counsel Shoaib Razzaq said it is our request JC be constituted to probe into murder of other journalists beside Arshid Sharif.The petitioner Hamid Mir said target killing of other 14 journalists was also made. No journalist was killed in any accident and but was killed in bomb explosion or firing.The counsel told the court no progress has been made by JIT constituted by SC. Arshid Sharif did not hold visa of any country.CJ IHC Aamer Farooq remarked what happened yesterday, Pakistan is still in the state of war. Youths were going outside the country still. Arshid Sharif too was citizen of Pakistan.Azhar Siddique counsel for petitioner said we are saying this commission be constituted which should tell why Arshid Sharif went outside the country. I have been listening this since last two years that some agreement is going to be signed with government of Kenya.The court inquired AG what they are talking about agreement will be executed till what time.AG replied we can say to foreign office for mutual legal assistance. Foreign office can request to the ambassador of Kenya. Even if JC is formed it will not be able to make investigation in Kenya.CJ IHC inquired what progress can be made after mutual legal agreement.AG replied the people related to Arshid Sharif murder are there in Kenya. The persons who took Arshid Sharif from airport and the person who was present on the scene are present in Kenya. Even if JC is formed it will not be given access to Kenya. The authorities of Kenya will not be bound to appear before commission.The court further inquired if agreement is reached with Kenya then will it be for the purpose of provision of evidence.The counsel Shoaib Razzaq told the court this high court a day before gave decision in respect of all the cases registered against Arshid Sharif all over the country.The court said in its decision Arshid Sharif was harassed by public authorities and agencies. One journalist was killed. Every one knows what is the situation that Arshid Sharif had to leave the country. Message came to me that one more FIR has been registered. Arshid Sharif was firmly committed that he would not leave country. He did not have visa even.The court remarked we understand your sen timents. But this court has to give decision as per law and not emotions.The counsel told the court our case is this as to how so many cases were registered against Arshid Sharif. Our case is this how Arshid Sharif was harassed and was forced to leave the country.The court reserved judgment on Hamid Mir petition regarding formation of JC to probe into murder of Arshid Sharif.
