Islamabad:Islamabad High Court (IHC) has restrained CDA from demolishing building of citizen and taking any punitive action against him has sought parawise comments and report before next hearing.
Justice Muhammad Khan of IHC while issuing notice to the CDA on the petition filed by citizen Malik Mumtaz Ali Khan has issued stay order besides seeking parawise comments and report before next hearing.
According to petition CDA is constructing service road near Koral Chowk. CDA had given notice on October 01, 2026 for removing alleged encroachments within 3 days. It had declared 35 feet 7 inch land violation of right of way.
The petitioner took the plea he purchased the land 20 years before and constructed it at heavy cost. A distance of 30 feet was left between home and road when service road was expanded 10 years back. If land is needed for further expansion of road then it be acquired as per law. Interference be not made in the right to ownership unjustly and illegally.
The petitioner challenged the notice related to home located in highway street village Koral.
