Islamabad: Islamabad High Court (IHC) has upheld the single bench decision on halting implementation of recommendation of National Assembly (NA) special committee for sacked employees regarding reinstatement and regularization of the sacked employees.
Division bench of IHC rejected intra court appeals against the decision of its single bench.
Justice Arbab Muhammad Tahir and justice Inam Amin Minhas rejected the appeal pleas declaring them against merit;.
it has been said in the written decision the proceedings of special committee was limited to advisory role and present the report in NA. The proceedings of the committee to this extent is declared within legal and constitutional parameters.
It was further said the directives issued by special committee to the heads of the departments for reinstatement and regularization of the employees are not as per law.
The directives in connection with seniority and fixation of pay are not in accordance with law and are without jurisdiction powers.
Such moves cannot be declared mere irregularity but it is violation of legal and constitutional framework,
These steps by the special committee are tantamount to interfere in the powers of executive and judiciary.
The NA special committee had issued directives to regularize, contract, daily wages and project employees.
Qadir Khan Mandokhail was the head of NA special committee for sacked employees in connection with reinstatement and regularization of employees.
