Islamabad: During the hearing of the case against not providing the power of attorney for filing bail pleas of Imaan Mazari and Hadi Ali Chattha , Anti Terrorism Court (ATC) Islamabad judge Tahir Abbas Sipra has again directed Deputy Superintendent (DS) jail to get power of attorney from sessions court and enter them in the register besides handing over them to the lawyers after getting them signed. .
He issued these directives on Thursday during the hearing of the case.
Counsels Riasat Ali Azad and Zainab Janjua appeared in the court on behalf of Imaan Mazari and Hadi Ali Chattha. Deputy superintendent Adiala jail appeared in the court on court's order. Dr Shireen Mazari too appeared in the court.
Counsel Riasat Ali Azad told the court during the hearing of the case the power of attorney of Hadi Ali Chattha has been received while power of attorney of Imaan Mazari has not been received.
Judge Tahir Abbas Sipra said session court is responsible with reference to jail power of attorneys. Report was called from Adiala jail on the request of lawyers.
It was disclosed in the Adiala jail report presented in the court that as per register and digital record the power of attorneys of Imaan Mazari and Hadi Ali Chatha have not reached jail so far. \
Judge Tahir Abbas Sipra pointed out the power of attorney of Hadi Ali Chattha has been received .
However deputy superintendent jail told the court this power of attorney does not bear their signatures. Inquiry is under way in this regard how these signatures were made.
He requested the court the report be got verified after calling it from superintendent jail.
counsel Zainab Janjua told she had met this deputy superintendent jail on Monday in jail wherein he had assured that the power of attorneys will be processed in a day or two. Therefore, power of attorney be provided just now.
Counsel Riasat Ali Azad took the plea both the accused were sent to jail on the order of court. This is an extraordinary case that power of attorney are not being provided since one week. if any harm is caused to them in jail then jail authorities will be responsible.
Expressing concern he said we don't know Imaan Mazaari may have been killed.
Judge Tahir Abbas Sipra while restraining the counsel from using improper words on remand order said if this order has not been challenged then it cannot be criticized this way.
Dr Shireen Mazari said to the court what power of attorneys they had taken with them were not accepted. Therefore, oath be taken from jail authorities on holy Quran . She fears her daughter has been killed or has been made missing.
Judge Tahir Abbas Sipra again directed deputy superintendent jail to obtain the power of attorneys from sessions court and enter them in register. These be got signed and be handed over to the counsels.
The court adjourned the hearing of the case till September 26.
