Islamabad: PTI founder Imran Khan and his wife Bushra Bibi have challenged the decision of Toshakhana-2 case in Islamabad High Court (IHC).
Appeal pleas against conviction of Imran Khan and Bushra Bibi in Toshakhana-2 case have been filed through counsel Khalid Yusuf Chaudhry.
IHC has marked diary number 24561 on appeal plea of Bushra Bibi and number 24560 on appeal plea of Imran Khan.
The petition said the court relied on the statement of Inam Ullah Shah who had been dismissed. The court relied on the statement of approver and it cannot be done so. The prosecution failed to prove case against Imran Khan and Bushra Bibi.
The petitioners while praying the court to nullify the court's decision in Toshakhana-2 case have taken the plea punishment cannot be given several time in one offence. Special central court had no powers of jurisdiction to hear this case.
It was further said in appeal plea Sohaib Abbasi was made approver illegally. The former ruling couple kept Bulgari jewelry set with them as per rules.
The case was registered without the investigation. Both Imran Khan and Bushra Bibi are being subjected to political victimization. The petitioner does not fall in the definition of government employee.
The court has been prayed to fix the appeal pleas for early hearing.
