Islamabad: Justice Amin ud Din Khan head of Supreme Court (SC) constitutional bench and Justice Jamal Mandokhail have recused from hearing case pertaining to appointment of chief justice Lahore High Court (LHC) Justice Aalia Neelum.Upon it the bench was dissolved and the case would be fixed for hearing before any other bench.The petition against appointment of chief justice LHC came up for hearing before SC constitutional bench.Justice Amin ud Din Khan said he was member of Judicial Commission (JC) in connection with appointment of chief justice LHC.Justice Jamal Mandokhail remarked he and Justice Amin ud Din are members of JC. Two members of JC cannot hear this case. JC has been made respondent in this case.AAG said seniority is no basic right. Examples are there in regard to appointment of chief justice in the past without seniority.The SC constitutional bench ordered to fix the case of appointment of chief justice LHC Aalia Neelum in other constitutional bench.
