Justice Tariq Jahangiri expresses lack of confidence on IHC CJ Dogar led bench in degree case

Islamabad: Islamabad High Court (IHC) while adjourning hearing of dispute degree case in respect of Justice Tariq Jahangiri has directed Karachi university to provide record to learned judge.

Justice Tariq Jahangiri of Islamabad High Court (IHC) has expressed lack of confidence on the bench led by Chief Justice (CJ) Sarfraz Dogar in his degree dispute case and has requested for transferring the case to some other bench.

IHC bench comprising CJ Sarfraz Dogar and Justice Azam Khan took up controversial degree case for hearing Monday.

Justice Tariq Jahangiri and counsel for Islamabad Bar Association appeared in the court.

CJ IHC Sarfraz Dogar said I am requesting as CJ that the learned counsels should take their seats . The learned justice Tariq Jahangiri has come. The others should take their seats.

Justice Tariq Jahangiri said notice was received by him on Thursday. Copy of petition is not attached with the notice. It is 34 years old case. Give me time for making available copy to me.

Justice Tariq Jahangiri while raising objections over sitting of Sarfraz Dogar in the bench said you are judge and I am too a judge . My appeal plea is pending hearing against you.

Justice Tariq Jahangiri said this is clash of interests. You cannot sit against me in my case. It is my objection you should not hear the case. Division bench never hears writ of quo warranto . Single bench hears it. You restrained me from performing judicial obligations which has never happened in the judicial history. Even Naib Qasid is not prevented from performing duty this way.

CJ IHC said the justice will be provided to you what is provided to any other individual.

Justice Tariq Jahangiri said indictment is framed after 7 days in murder case too. You gave notice of only three days. You should not do so in quo warranto writ. If this is set court's precedence then it will have disastrous implications.

Justice Tariq Jahangiri stated, under oath, that his degree was genuine . University has not said this the degree is fake but it had not issued it.

While moving to CJ IHC, Justice Tariq Jahangiri said I have no trust on your bench. If case has to be heard then it should be sent to some other bench. I should be given some time too.

The court while summoning Karachi university registrar along with the record directed to provide copies of petition and all relevant documents to justice Tariq Jahangiri.

The hearing of the case was adjourned till December 18.
