LHC dismisses petition regarding legislation on marital violence, abuse during marriage

LAHORE:Lahore High Court (LHC) has rejected the petition regarding legislation in connection with abuse during marriage and marital violence.

It has been said in the decision that constitutional rights and human dignity of any woman are not reduced due to marriage.

The marriage does not allow any spouse to subject other spouse to violence.

Legislation making is the constitutional mandate of Parliament and provincial assembly.

The decision said that the courts cannot legislate in place of parliament . Several laws for protection of the women against the domestic violence are in place in Punjab and other provinces. Assembly, if wills so, can legislate on this matter as per constitution.

Justice Abher Gul Khan issued written decision on the petition by lawyer Areej Sohail.
