LHC RWP bench nullifies subordinate court decision of handing over custody of children to aunt

Rawalpindi: Justice Sardar Muhammad Sarfraz Dogar of Lahore High Court (LHC) Rawalpindi bench has nullified subordinate court decision on the petition pertaining to handing over custody of minor children.The court has ordered police to get the children from aunt and hand over them to mother. The petitioner along with children be taken into protective custody by police and they be cordoned off to their home.The court issued these orders on the petition of Iqra Anwar resident of Abbas Nagar Pindadan Khan Thursday.Iqra Noor had filed petition through her counsel Syed Muhammad Taqi Hussain Kazmi advocate against the decision of additional district and sessions judge Pind Dadan Khan.During the hearing of the case the court remarked there is no importance of opinion or statement of minor children. Love of mother and lap of mother is inevitable for minor children. Because nature has not made any other thing substitute for mother. Supreme Court decisions are there for guidance in this regard that minor c hildren will stay with mother in the event of family dispute.The counsel for petitioner said the decision was issued by subordinate court in haste. The decision runs contrary to the norms of justice. Aunt has no privilege over the children in the presence of real mother. The children were snatched from the petitioner forcibly. Subordinate court also made legal mistake in the decision.The court while agreeing to the arguments of the counsel for petitioner declared subordinate court decision null and void.
